89TH LEGISLATURE SPECIFIC

Be it Resolved: There shall be no gun-free zones in Texas and the United States.

BACKGROUND (Not part of the resolution): Whereas, potential attackers are attracted to “gun-free” areas where they are free to commit evil; Whereas, law-abiding citizens’ ability to respond is limited by “gun-free” areas; Whereas, “gun-free” areas provide a false sense of security; Whereas, “gun-free” areas are empirically more likely to be the location of mass-shootings.

Be it Resolved: Tenants of leased premises should not be evicted for acting in justified defense.

BACKGROUND (Not part of the resolution): Whereas, a person’s habitation is universally regarded as the ultimate refuge for individuals and families, a place where they have a right to feel safe and secure; Whereas, a person may feel particularly vulnerable, especially during the night or when they are asleep; Whereas, a homeowner is not forced to leave their home following a justified defense incident; Whereas, tenants of rental property are being forced to vacate their property or are being evicted after acting in justified defense with a firearm; Whereas, Texas law treats tenants who act in justified defense with a firearm differently than homeowners.

Be it Resolved: Short-barred firearms shall be decriminalized in Texas and the United States.

BACKGROUND (Not part of the resolution): Whereas, the individual right to keep and bear arms shall not be infringed; Whereas, individuals have a right to choose the best tool to protect themselves and others; Whereas, there should not be a legal distinction between a concealable handgun and other concealable firearms; Whereas, the ATF has overstepped its rule-making authority and caused administrative confusion with regard to certain types of firearms.

Be it Resolved: All firearm carry licenses and permits issued by another state shall be recognized by Texas.

BACKGROUND (Not part of the resolution): Whereas, the individual right to keep and bear arms shall not be infringed; Whereas, national reciprocity and the recognition of firearm licenses and permits from all states aid in interstate travel and commerce; Whereas, national reciprocity aids in uniformity and simplification of laws; Whereas, licensed gun owners are one of the most law-abiding demographics in the country; Whereas, more licensed guns owners enhance public safety by serving a deterrent and immediate first-response to violent crime; Whereas, driver’s licenses and marriage licenses are provided equal and fair treatment under Texas law; Whereas, full faith and credit should be extended to firearms license and permits.

Be it Resolved: Individuals who have acted in justified defense should be entitled to assert their defense prior to trial.

BACKGROUND (Not part of the resolution): Whereas, a person who has acted in justified defense is frequently charged with a crime and dragged into the criminal legal system; Whereas, justification is an affirmative defense that must be proved at trial; Whereas, the only person or group of people who are legally required to consider a justification claim are a trial judge or trial jury; Whereas, defending oneself from a criminal accusation can be costly and time-consuming; Whereas, the longer a criminal proceeding lasts the more expensive and time-consuming it becomes; Whereas, a trial occurs at the end of a legal proceeding; Whereas, it would reduce the cost on an individual who has acted in justified defense if they could assert their defense early in the criminal proceeding.

Be it Resolved: The Governor of Texas should be prohibited from disarming and restricting the carrying of firearms during an emergency.

BACKGROUND (Not part of the resolution): Whereas, the individual right to keep and bear arms shall not be infringed; Whereas, individuals have a right to protect themselves; Whereas, individuals should have the right to wear and carry arms for the defense of themselves and others; Whereas, individuals are most vulnerable during a disaster; Whereas, Texas law currently permits the governor to prohibit the wearing and carrying of arms during a disaster.

Be it Resolved: Individuals who have acted in justified defense should presumptively be immune from civil liability.

BACKGROUND (Not part of the resolution): Whereas, Texas Civil Practices and Remedies Code Chapter 83 provides civil immunity for damages to a person who uses force or deadly force that is justified; Whereas, immunity from damages does not keep a person from being sued or having to respond and participate in a lawsuit; Whereas, being sued is costly and time-consuming; Whereas, many individuals who have acted in justified defense are incurring significant civil legal expenses; Whereas, legal presumptions offer a framework to manage uncertainties and streamline legal proceedings; Whereas, Texas Civil Practices and Remedies Code Chapter 83 is ineffective at deterring frivolous lawsuits.

Be it Resolved: The individual inalienable right of self-preservation shall be protected by Texas and the United States.

BACKGROUND (Not part of the resolution): Whereas, each individual is the moral rightful owner of their person and, therefore, has a right to self-preservation; Whereas, the government should enact laws to guarantee the right to self-preservation.

Be it Resolved: All infringements to the individual inalienable right to self-preservation shall be repealed by Texas and the United States.

BACKGROUND (Not part of the resolution): Whereas, each individual is the moral rightful owner of their person and, therefore, has a right to self-preservation; Whereas, the government should remove all laws that interfere with the right to self-preservation.

Be it Resolved: The individual inalienable right to keep and bear arms shall be protected by Texas and the United States.

BACKGROUND (Not part of the resolution): Whereas, each individual has a right to self-preservation; Whereas, an individual should decide the proper tool to secure their right of self-preservation.

Be it Resolved: All infringements to the individual inalienable right to keep and bear arms shall be repealed by Texas and the United States.

BACKGROUND (Not part of the resolution): Whereas, each individual has a right to self-preservation; Whereas, laws that interfere with an individual’s decision of the proper tool to use to secure the right to self-preservation make the individual less safe.
